TERMS AND CONDITIONS of IRCTC SHUBH YATRA MEMBERSHIP

SHUBH YATRA MEMBERSHIP

* The terms and conditions set out in the following pages are important and affect your rights as a member of Shubh Yatra
* You must agree to all of these before applying for Membership to Shubh Yatra. Your applying for membership to Shubh Yatra is deemed as acceptance of the following terms and conditions.
* You must read these terms and conditions before quoting your Shubh Yatra membership number to IRCTC or any Programme Partner.


Membership Agreement

These terms and conditions set out the contractual relationship between IRCTC and each individual member of Shubh Yatra.


Definitions

The definitions given here relate to the terms mentioned in the Shubh Yatra Programme, unless the context states or requires otherwise:
* 'IRCTC' means Indian Railway Catering and Tourism Corporation Ltd. having its registered office at Bank of Baroda Building, 16, Parliament Street, New Delhi 110001
* 'Shubh Yatra ' is the programme name for the Indian Railways Frequent Traveller Programme, managed and operated by IRCTC, offering benefits, facilities or arrangements to members by reason of their membership in the programme.
* 'Shubh Yatra Card' and 'Membership Card' mean the Shubh Yatra membership card.
* 'Member' means a member of the Shubh Yatra and whose name is printed on the card.
* 'Applicant' means any individual who fills in the Shubh Yatra Enrollment Form on the IRCTC website www.irctc.co.in
* 'Railway Points' are credits accumulated as Railway Points by a member onto his/ her Shubh Yatra membership account .
a. for traveling on an IRCTC qualifying train journey on eligible classes of travel or
b. for using Shubh Yatra partners' services as the case may be,
c. these reflect on the statement issued by IRCTC.
* 'Data' means personal information of a member.
* 'Fraud' includes fraud, dishonesty and deceit and in particular:
a. Knowingly supplying incorrect information, including at the time of booking, to accrue Railway Points.
b. Attempting to accrue Railway Points for Sectors that have not been traveled or are not eligible for Railway Points.
c. Altering documents to procure Railway Points.
d. Attempting to accrue Railway Points for sectors traveled on by any person other than the member.
e. Using or attempting to use stolen or counterfeit tickets on Indian Railways.
f. Attempting to accrue Railway Points more than once for the same sector.
g. Selling, bartering and/or purchasing Railway Points, including attempting to sell or transfer Railway Points by means of Internet-based sales or auctions from any other entity but IRCTC.
h. Knowingly benefiting from the Fraud or Misconduct of another member or individual.
i. Booking and subsequently canceling tickets after date of journey to benefit from fraudulent credit of Railway Points
* 'Loss' means losses, costs, damages, injuries, accidents or claims (whether direct or indirect) suffered by members in connection with the provision of services.
* 'Processing' and 'Processed' includes obtaining, using, recording and holding in electronic or any other form.
* 'Sector' means a single direct eligible rail travel sector between two destinations, e.g.: Delhi - Mumbai.
* 'Programme Partner' means partners and companies which include but are not limited to financial and insurance institutions, hotels, car rental and publishing companies who provide services to Shubh Yatra members.
* 'GEBPMSL' means GE Capital Business Process Management Services Pvt. Ltd., a company incorporated under the Companies Act 1956, having its registered office at No.1, AIFACS Building, Rafi Marg, New Delhi 110 001 and corporate office at 90 A, Sector 18 Udyog Vihar NH-8, Near IFFCCO crossing, 1st Floor, Gurgaon - 122015, Haryana, that manages, operates and administers the Shubh Yatra Programme and membership card for IRCTC.
* 'SBICPSL' means SBI Cards and Payment Services Pvt. Ltd., a company incorporated under the Companies Act 1956, having its registered office at SBI Local Head Office, 11 Parliament Street, New Delhi 110001, and is the issuer of the IRCTC Co-brand Credit Card.


Membership

* Membership to Shubh Yatra is open only to individuals, who are above the age of 18 years and below 60 years. It is clarified that senior citizens or other customers who purchase discounted tickets [or tickets issued against vouchers] (for example students, handicapped or military personnel) will not be permitted to enroll and become a member of Shubh Yatra.
* IRCTC reserves the right to enroll individuals of certain countries and/ or regions, subject to their having an Indian mailing address. Such countries and/ or regions are subject to change.
* Membership is not open to companies, partnerships, unincorporated associations or similar entities.
* Membership to Shubh Yatra is offered at the discretion of IRCTC and IRCTC may refuse membership to any applicant. Shubh Yatra is paid membership programme for IRCTC registered users.
Currently, membership fee for Shubh Yatra is Rs 500 with an annual renewal fee of Rs 300, exclusive of applicable Taxes, presently 12% Service Tax and 2% education cess on service tax.
Both the membership fee and the renewal fee are subject to change at the discretion of IRCTC. There shall be a grace period of ninety days from the date of expiry of Shubh Yatra membership for payment of renewal fees. During this period though accrual of Railway Points shall be permitted, no redemption of Railway Points can be availed. After the expiry of this grace period and non-payment of renewal fees, the account expires. Railway Points will be obliterated and these cannot be reinstated.
* To apply for membership, an individual must complete an Application/Enrollment Form or apply online at or apply for the SBI Railway Card.
* Membership commences as soon as the Shubh Yatra member is in possession of the Shubh Yatra membership number. However, Railway Points are credited to the account only five days after the date of travel provided the ticket has not been cancelled. These Points shall be credited to member's account, when member travels on a ticket booked through IRCTC website, www.irctc.co.in. The individual needs to be an active member of the Shubh Yatra programme at the time of ticket booking and also on date of travel. If the individual is also a subscriber to the SBI Railway Card, then the individual will be governed by the terms & conditions of the SBI Railway Card in conjunction with those of the Shubh Yatra programme.
* The member agrees that by applying for / using the Shubh Yatra membership card and by quoting his/her membership number to IRCTC and/ or any Programme Partners, he/she has read and understood the terms and conditions of the Shubh Yatra programme, and confirms that he/ she is bound by such terms and conditions.
* A Shubh Yatra membership card is valid only for use till the validity of membership. The member named on the Shubh Yatra membership card is the only person who may use the membership card for any purpose whatsoever. A Shubh Yatra membership card is not transferable and is not a credit card.
* A Member shall notify the Customer Service Centre immediately if a Membership Card is lost, stolen or damaged. If lost, the Shubh Yatra membership card will be reissued by IRCTC upon receiving a written request from the member at the www.irctc.co.in website. Subject to the other provisions hereof, a new Membership Card will be issued to the Member within a reasonable time, after payment by the Member of the necessary fees/charges towards the cost of processing a new Membership Card and towards administrative costs. Currently this fee is Rs 75, exclusive of applicable Taxes, presently 12% Service Tax and 2% education cess on service tax.
Until the new Membership Card is received, the Member shall retain all documents of travel performed during this period.
* Shubh Yatra membership numbers are non-transferable.
* A person may be enrolled to only one Shubh Yatra membership account. In the event that more than one account number is assigned to the same individual (duplicate accounts), IRCTC reserves the right to merge the two accounts.
* Misuse of Shubh Yatra membership cards or programme benefits may result in termination of membership or withdrawal of benefits at the discretion of IRCTC.
* If benefits, facilities or arrangements are provided or made available to a member as a result of his/ her membership, whether these are provided by IRCTC or by Programme Partners, such a member will be personally liable for any and all costs, taxes, charges, claims or liabilities of whatever nature arising from the provision or availability of such benefits, facilities or arrangements.
* The Shubh Yatra membership card remains at all times the property of IRCTC, which reserves the right at any time in its absolute discretion and without giving notice to such member to refuse membership or to revoke membership. The member must return his/her Shubh Yatra membership card within 15 working days whenever requested by IRCTC.
* While IRCTC will endeavour to see that the services, benefits, facilities and arrangements as expressed or advertised by the Programme Partners will be available to the members, IRCTC will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision, whether in whole or part, of any such services, benefits, facilities or arrangements.
* When a member seeks to use or obtain any of the services, benefits, facilities or arrangements offered, the provision of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the provider of said benefits, facilities or arrangements.
* A member must quote his/her Shubh Yatra number and name as mentioned on his/her card when booking on www.irctc.co.in and/ or using the services of a programme Partner. If a member fails to provide the required membership information accurately when making such booking or availing such services, this may result in the applicable Railway Points not being credited to the member's account and IRCTC or its Programme Partners will not be responsible in this regard.
* Only the member is eligible to obtain information from IRCTC relating to such membership data including but not limited to travel data, Railway Points accumulated and class of travel.
* IRCTC may at any time, without giving notice, change the Points structure by revising the Railway Points required to attain a particular complimentary ticket, stipulate a specified period during which Railway Points cannot be redeemed; limit the number of seats available for the redemption of Railway Points to any or all destinations or on certain specified routes; alter the number or types of journeys required to obtain a particular complimentary ticket; change or withdraw Programme Partners' affiliations; change the parties from which a complimentary ticket may be obtained/redeemed; change the length of time after being awarded within which Railway Points must be redeemed; impose a time limit upon the validity for redemption of any Railway Points issued by IRCTC or any Programme Partners; introduce and or review membership fees; and modify the procedures and rules relating to ticketing on redemption of Railway Points or other aspects of the Shubh Yatra Programme.
* IRCTC reserves the right to terminate at any time, without giving any notice, throughout the world, or in a specific country, in which IRCTC is associated with its Programme Partners, the right of any or all members to earn or redeem Railway Points.
* IRCTC shall not be liable for any loss or damage, whether direct or indirect, resulting from termination or change of, or to the Shubh Yatra programme or any of the facilities, benefits or arrangements which are made available to members, including, without limitation, Programme Partners' withdrawal or the withdrawal or limiting of any such services, benefits or facilities.
* If member wishes to discontinue his membership, he shall submit a request to the same to IRCTC in writing. The member shall return the membership card to IRCTC and member shall cease to receive any of the benefits of the programme.
* Indian laws govern these terms and conditions. In the event of any disputes, the appropriate court in New Delhi shall have exclusive jurisdiction.


Enrolment

* Via Website Registration
a. Potential members may apply to enroll into the Shubh Yatra programme through the IRCTC website www.irctc.co.in and may start to quote the Shubh Yatra membership number that is sent to him/her via e-mail on successful completion of the online enrolment process. Once the form is submitted, prospective member is taken to the payment gateway page, where he pays applicable membership fees. After the confirmation of the payment a Shubh Yatra Membership Number is generated and shall be emailed to the prospective member.
b. Membership, however, is not confirmed until the online registration has been accepted and processed by IRCTC and Points credits accrued will not be honoured until 5 days after date of first travel.
* Via SBI Railway Card
a. Prospective members may apply to enroll into the Shubh Yatra programme by applying for a SBI Railway Card. Approved SBI Railway Cardholders would be given complimentary membership of the Shubh Yatra Programme. The Shubh Yatra membership number would be sent to the member by e-mail. Approved SBI Railway Card holders will be governed by the terms and condition of the SBI Railway Card in conjunction with those of the Shubh Yatra programme.
* Accuracy of Information
a. Applications will not be considered for enrolment if any of the details provided at the time of enrolment are found to be incorrect or non-factual.
b. An applicant for membership must supply all of the information required in the Shubh Yatra membership application form.
c. IRCTC may accept or reject any application for membership in its absolute discretion. If an application for membership is rejected, then any benefit that may have accrued to the applicant through the use of a temporary membership will be null and void.


Updating Account Information

* It is the responsibility of the Shubh Yatra member to advise IRCTC of any changes in his/her name, address or preferences. Members need to update their address and preference details directly online at www.irctc.co.in
* Name change requests are not allowed, however an exception may be made, if a written request is sent to IRCTC, duly signed by the member.
* Requests for changes in name should be accompanied by supporting legal documentation, as may be specified at the time of making the name change request.


Earning of Railway Points

* On IRCTC booking and Rail travel
a. To ensure credit of Railway Points, the member must make all his bookings in the same name as the name printed on the Shubh Yatra membership card.
b. To earn Railway Points, the member will have to mandatorily be one of the travelers listed on the railway ticket. The member must quote his/her Shubh Yatra membership card number at the time of making the booking and also present his/her Shubh Yatra membership card/identification proof at the time of checking by Ticket Collector.
c. Failure to give complete/ correct information may result in the Railway Points due for that activity not being credited to the member's account and the member not receiving certain service benefits.
d. Railway Points will not be awarded where the train for which ticket booked is cancelled due to any reason beyond the control of IRCTC & force majeure.
e. The responsibility to check that Railway Points and Activities have been properly credited lies with the Shubh Yatra member. This can be checked online at www.irctc.co.in or by calling the Shubh Yatra helpline.
f. All activities that are not tracked automatically at the time of travel may be credited later at IRCTC' discretion provided that the claim is made within 2 months from the date of travel. Claims must be lodged within 2 months from the date of travel.
g. In case of dispute about entitlement to Points credit, IRCTC may require proof of travel on the relevant sector including the ticket and passenger receipts for the sector claimed to have been traveled. Claims must be lodged within 2 months from the date of travel.
* Railway Points are credited to the account only 5 days after the date of travel. These Points shall be credited to loyalty member account, when loyalty member travels on a ticket booked through IRCTC website. Member needs to be member of the loyalty program during ticket booking and on date of travel.


Transfer of Railway Points

* Railway Points are not transferable and cannot be combined with the Points/points of any other account.
* At no time may Railway Points be credited to, or complimentary tickets be purchased by, any person other than the member. Any such Railway Points or complimentary tickets are void if transferred for cash or other consideration. Any person who commits such acts is liable for damages, litigation and related costs to IRCTC who reserves the right to terminate membership of such persons. Railway Points can, however, be redeemed for complimentary tickets for the member, or his family and friends or any person, duly authorised by the member.
* Use of complimentary tickets that have been acquired by purchase or for any other consideration may result in the complimentary tickets being confiscated. In such cases if a trip has already commenced, the remaining portion of the travel will not be eligible for the benefit of complimentary tickets and such travel will be at passenger's expense on a full-fare basis.


Points Calculation

* Railway Points will be credited to the member's account based on his/her class and sector of travel. Railway Points shall accrue only on 1st Class AC, AC II Tier, Executive Chair Car and AC Chair Car travel. No Railway Points shall accrue on tickets booked through Mobile Phone. These Railway Points are accrued on basis of a particular ratio, which is subject to change at the discretion of IRCTC; 4 Railway Points for every Rs 100 spent if the Date of Travel lies between in 1 April to 14 July or 16 September to 14 January in any year; 10 Railway Points for every Rs 100 spent if the Date of Travel lies between 15 January to 31 March and 15 July to 15 September in any year. This is subject to change at the discretion of IRCTC. Railway Points shall always be rounded off to the lower integer.
* Points can be accumulated only once per rail journey per member, regardless of the number of seats purchased. Points shall be calculated as per the member's individual fare and not on the fare of the entire ticket, in case the ticket has more than one passenger. Points will be credited only to the member who has traveled on the train, on the relevant sector, and not to any third party, irrespective of who has paid for the seat.
* Railway Points credit for a member's travel on IRCTC shall be based on the railway base fare between the cities where the member's travel begins and ends.
* Fares are subject to change at the discretion of Ministry of Railways, India.
* Railway Points credit will be awarded according to the class of travel booked, regardless of the class of travel journeyed.
* For travel booked on discounted/concessional IRCTC fares, i.e., Senior Citizen etc., no Railway Points may be credited.
* Points credit is not applicable for the following:
a. Refunded, forfeited and unused tickets, including non-refundable tickets.
b. Travel agents, tour conductors and/ or other persons traveling on non-revenue basis or travel industry/ cargo customer discount fares.
c. Free tickets of any kind.
d. Tickets booked through mobile phone.
* Validity of Railway Points
a. Railway Points will lapse after the expiry of three years from the date of registration of the member. For example, if Account Year for Membership No. 123456789 lies from 05.09.06 to 04.09.07 and points accrued during 05.09.06 to 04.09.07 is 1050, the expiry date for points accrued during 05.09.06 to 04.09.07 would be 05.09.09 i.e. three years from the date of registration. If the member has redeemed 1000 points before 05.09.09 then the system shall expire the balance of 50 points from the Membership account on 05.09.09. However, irrespective of the three-year validity period, Railway Points will lapse if member does not renew his/her membership.
b. Railway Points may be accumulated by the Member only during the period of the validity of the Membership and any Points so accumulated by the Member must be redeemed, subject to the other terms hereof, within a period of 3 years from the date of membership’s registration.
* Reporting of Railway Points credit and other account information.
a. Railway Point statements are sent periodically to members reporting all activity recorded in their Shubh Yatra Account since the earlier statement sent. The summary indicates the Points credit earned as well as Points redemption activity, if any.
b. All Railway Point discrepancies must be reported to the IRCTC at www.irctc.co.in within 60 days of completion of the activity.
c. All Shubh Yatra members will receive their Points statement via e-mail at least once every quarter.
* Reporting of account discrepancies
a. Members are advised to retain their original tickets till Points credit appears on their Points statement and report any omissions in their Shubh Yatra Account to IRCTC online at www.irctc.co.in
b. IRCTC is not responsible for and written or verbal communication /notification for Points credit discrepancies, unless reported online at www.irctc.co.in.
c. Altered or illegible documents will not be accepted for the purpose of crediting / debiting of Railway Points as the case maybe.


Redemption of Railway Points

* General conditions
a. Members can redeem their Railway Points for a complimentary ticket only after they have recorded a minimum of 500 Railway Points in their Shubh Yatra Account earned though travel on tickets booked at www.irctc.co.in. Each Railway Point shall be equivalent to Re 1. This conversion ratio is subject to change at the sole discretion of IRCTC.
For redemption of Railway Points for free rail travel, the following policy shall apply:
o Redemption shall be allowed only if member has accessed the IRCTC website through his own login (username and password)
o Ticket purchased with points redeemed must have the Shubh Yatra member as a passenger on the ticket.
o Redemption can be made only against full fare of ticket, inclusive of fares of all the passengers on that ticket.
b. Complimentary tickets will only be issued to and from destinations served by IRCTC designated at the time the ticket is issued and also at the time the ticket is used. Redemption of Railway Points shall be permitted only on 1st Class AC, AC II Tier, Executive Chair Car & AC Chair Car, for all sectors
c. Complimentary tickets issued against redeemed Railway Points are not eligible for earning Points credit.
d. All complimentary tickets are subject to the rules and restrictions of the appropriate governments. For additional travel conditions or restrictions, please check with IRCTC.
e. Sale, purchase or barter of Railway Points is not permitted and will be considered as illegal.
f. Complimentary tickets issued against redeemed Railway Points have no monetary refund value.
g. If the member does not have enough Railway Points to purchase his/her redeemed ticket he/s he may purchase the remaining Railway Points at any point of time; either while booking his/her ticket or before he/she initiates the ticket booking process. Currently these Railway Points may be purchased at the cost of Rs. 1.50 per Railway Point. Member can purchase Railway Points only when he/she has a minimum of 500 Railway Points in his/her account accrued through purchase of tickets from www.irctc.co.in.
* Claiming a complimentary ticket by redeeming Railway Points
a. Requests for all complimentary tickets must be made to the IRCTC by requesting the same at www.irctc.co.in, in accordance with such procedures as may be in force from time to time.
b. Such requests will not be considered valid unless completed in all respects.
c. Complimentary tickets issued against redeemed Railway Points will be booked and issued by IRCTC ONLY. Travel agencies are not authorised to book and issue such complimentary tickets.
d. The passenger shall also be responsible for all other expenses and any other charges, claims or liabilities arising in relation to the use of tickets for complimentary tickets issued against redeemed Railway Points. e. While redeeming Railway Points for complimentary tickets, member should have enough points to cover the fare of all passengers on the ticket.
* Cancellation of Complimentary Ticket
a. Complimentary tickets will be permitted to be cancelled either on the counters or in the systems (depending on whether they are I-tickets or E-tickets). Cancellation fee of additional 50% of the total points on such cancellations will be charged. This charge will be in addition to the cancellation charges normally levied by Indian Railways as per the Railway Commercial Rule.
b. No Show passengers on complimentary tickets issued for redeemed Railway Points (Confirmed passengers who do not present themselves for their booked travel) will also attract 100% deduction of applicable Points.
c. No change of sector/ name/class/date is permitted on complimentary tickets issued for redeemed Railway Points. The same can only be cancelled.
d. In the event of a re-credit of any Railway Points, if the re-credited Railway Points are past their validity, the same will automatically expire from the member's account.
* Lost/ Stolen Complimentary tickets issued for redeemed Railway Points and Redemption
a. If a Complimentary tickets issued for redeemed Railway Points is lost or stolen, member should immediately inform IRCTC and simultaneously lodge a First Information Report (FIR) with the local police station.
b. IRCTC will advise the member if and when such ticket will be reissued.


Data Processing & Protection

* By using his/her Shubh Yatra membership card and/or quoting his/her Shubh Yatra membership number to IRCTC and/or any Programme Partners, a member consents to IRCTC creating, maintaining and updating data that is personal to the member. Such data includes membership data like name, address, telephone number, date of birth, employer, mother's name, etc., travel data (including without limitation, travels taken, Railway Points accumulated and class of travel traveled) and data concerning contacts with IRCTC (including without limitation, enquiries regarding membership) and will be maintained and updated for the purpose of providing relevant information and services to the member. Data will also include data received from Programme Partners about Railway Points accrued as a result of using services provided by Programme Partners.
* Before any data relating to a member is disclosed to the member by IRCTC, the member may be asked security questions, which may require him/her to confirm his her identity by providing information held by IRCTC or its partners.
* Members are responsible for the security of their online logins and passwords and IRCTC shall have no liability in the event that a member's login and/or password is disclosed by the member, whether intentionally or not, so as to allow a third person online access to the data and to make any transactions. IRCTC reserves the right to block online access to data by or through any third party website not authorised by IRCTC.
* In an effort to provide valuable offers to members, IRCTC develops mailing lists for use by themselves and their Programme Partners. These lists are based on information provided by the member at the time of enrolment. These lists are developed under strict conditions designed to safeguard the privacy of member's information. If a member does not wish to receive these offers, he/ she may request in writing to have his/ her name removed from the said mailing lists by contacting IRCTC.
* As part of providing value added services to the Shubh Yatra members, IRCTC in collaboration with its Programme Partners reserves the right to send special offers / products to the members, through Email/Postal mail/Telephone, based on his profile as recorded in his Shubh Yatra Account. Such Partner Offers will be sent automatically to the Shubh Yatra members.
* Consent to receive such offers will be deemed as given, until such time that the member withdraws consent to receive mailers and offers from IRCTC and its various Programme Partners by opting out of the relevant preference at www.irctc.co.in. Withdrawal of consent may mean that certain services may no longer be provided to the member.
* Any and all information in a member's Shubh Yatra Account may be disclosed as required by law, including disclosures to the police, immigration and customs authorities.
* Shubh Yatra card member details may be shared with SBICPSL, its affiliates, subsidiaries and/or any third party for the purpose of administration of membership accounts and/or marketing of their own products/services through e-mail, post, telephone or personal visits.


Audit & Disqualification

* IRCTC reserves the right to audit any and all members' Shubh Yatra Accounts at any time, without notice to the member(s), to ensure compliance with the rules set forth in this programme handbook. In the event that the audit reveals discrepancies or violations, the processing of complimentary tickets issued for redeemed Railway Points and Points summaries may be delayed until the discrepancies or violations are resolved.
* iolators may have their Shubh Yatra Accounts disabled/partially disabled (e.g., Railway Points may not be redeemed from a partially disabled account) or penalties imposed through the deduction of Railway Points from their Shubh Yatra Accounts.


Termination of Membership

* If the member wishes, he/she may terminate his/ her membership by providing notice in writing and by cutting his/her Shubh Yatra membership card in half and returning it to the IRCTC. Any such termination does not relieve the member of any continuing obligations under these terms and conditions.
* IRCTC reserves the right at any time in its absolute discretion to terminate the membership of any member and/ or the right of any member to use the Shubh Yatra membership card if a member commits fraud, misconduct, or if his account is disabled.
* Upon the death of a member, the Shubh Yatra Account will be closed. However, the member's legal heir, upon production of relevant documents, can redeem the Railway Points available in the deceased's Shubh Yatra Account till such time that they are valid for redemption.


Change / termination of the Shubh Yatra

* Membership enrolment and eligibility, earning Railway Points, complimentary travel, availability of complimentary tickets and redemption are subject to the terms and conditions of the Shubh Yatra Programme and are subject to any applicable laws and regulations, including applicable government regulations. IRCTC may change, add to, modify or withdraw at any time without giving notice such terms and conditions as well as any benefits provided in connection with the Shubh Yatra Programme and any special offers or promotional offers made to group of members.
* IRCTC and its Programme Partners reserve the right to change Shubh Yatra rules, regulations, Points calculations and special offers at any time without notice.
* IRCTC may terminate the Shubh Yatra Programme at any time but will use its reasonable endeavours to give at least three months notice to members. At the end of the period of notice, each member acknowledges that his/her right to use the services, including the earning and redemption of Railway Points, will cease.


Limitation of Liability

* IRCTC and/or Programme Partners shall not be liable to any member or his/her nominee or companion, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with the Shubh Yatra Programme and/or the provision or the refusal to provide any benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether IRCTC and/or its Programme Partners have any control over the circumstances giving rise to the claim or not.
* IRCTC will endeavour to ensure the availability of services provided by Programme Partners but will not be liable for any loss arising from the failure by Programme Partners to provide services.
* To the extent permissible by local law or regulation, these terms and conditions shall be governed by and construed in accordance with Indian law. IRCTC and each member submit to the non-exclusive jurisdiction of the Indian courts to resolve any disputes that may arise therefrom.
